Outliear Terms of Purchase
These Terms of Purchase (“Terms”) govern your purchase of high-performance wild/city clothing and other products (collectively, “Products”) from the Outliear website (the “Site”). By placing an order on the Site, you agree to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Refund Policy (all available on the Site). Please read these Terms carefully before making a purchase.
1. Order Placement and Acceptance
1.1 Order Submission
When you place an order on the Site, you are making an offer to purchase Products at the prices and terms displayed at the time of order placement. All orders are subject to acceptance by Outliear, and we reserve the right to reject or cancel any order for any reason, including but not limited to:
- Availability of Products (e.g., unexpected stock shortages).
- Errors in Product pricing, descriptions, or images on the Site.
- Suspected fraudulent activity or violation of these Terms.
- Inability to verify your payment information or shipping address.
1.2 Order Confirmation
Upon receiving your order, we will send a confirmation email to the email address you provided during checkout. This email will include your order number, details of the Products ordered, total amount charged (in USD), and shipping address. The confirmation email does not constitute acceptance of your order—we will send a separate shipping confirmation email once your order has been processed and shipped, which signifies our acceptance of your order.
1.3 Pricing and Currency
All Product prices displayed on the Site are in United States Dollars (USD) and include applicable taxes (where required by law). Shipping costs are waived for all orders worldwide—no additional shipping fees will be added to your order total, regardless of your shipping destination. We reserve the right to modify Product prices at any time, but such changes will not affect orders that have already been confirmed with a shipping confirmation email.
2. Payment Terms
2.1 Accepted Payment Methods
We accept the following payment methods for orders placed on the Site:
- Major credit cards: Visa, Mastercard, American Express, Discover.
- Digital payment platforms: PayPal, Apple Pay, Google Pay.
All payments must be made in full at the time of order placement. You represent and warrant that you have the legal right to use the payment method you provide, and that the payment information you submit is accurate and complete.
2.2 Payment Authorization
By submitting your payment information, you authorize us (or our third-party payment processor) to charge the total order amount to your selected payment method. If your payment is declined, we will notify you via email, and your order will not be processed until we receive a valid payment. We are not responsible for any fees or charges imposed by your bank or payment provider related to declined payments or chargebacks (unless such fees result from our error).
2.3 Chargebacks
If you initiate a chargeback with your payment provider without first attempting to resolve the issue with Outliear (e.g., requesting a refund, reporting a defective Product), we may dispute the chargeback and reserve the right to restrict or terminate your access to the Site. You agree to cooperate with us in any chargeback investigation, including providing any requested documentation.
3. Order Fulfillment and Delivery
3.1 Processing and Shipping Timelines
- Order Processing: We will process your order within 1–3 business days of receiving your confirmed payment. Processing time includes verifying your order details, preparing Products for shipment, and conducting quality checks.
- Delivery Timeline: After your order is processed and shipped, delivery will take 6–12 business days to any destination worldwide. This timeline is an estimate and may be affected by factors beyond our control, such as customs delays (for international shipments), carrier disruptions, or extreme weather conditions. We will provide a tracking number via email once your order ships, allowing you to monitor the status of your delivery.
3.2 Delivery Responsibilities
We will ship your order to the shipping address you provided during checkout. It is your responsibility to ensure that the shipping address is accurate and complete (including apartment numbers, building names, and postal codes). If your order is returned to us due to an incorrect or incomplete address, we will notify you via email, and you may request a reshipment (no additional cost) or a refund (subject to our Refund Policy). We are not responsible for lost or misdelivered orders caused by incorrect address information provided by you.
3.3 Title and Risk of Loss
Title to the Products passes to you upon delivery of the Products to the shipping carrier. Risk of loss or damage to the Products also passes to you once the carrier takes possession of the order. If your order is lost, damaged, or stolen during transit, please contact us at [email protected]—we will assist you in filing a claim with the carrier, but we are not liable for losses or damages incurred after the carrier has received the order (unless the loss or damage results from our negligence, such as improper packaging).
4. Returns and Refunds
4.1 Return Eligibility and Timeline
You may return any unused, unwashed, and undamaged Products (with original tags and packaging intact) for a refund within 60 days of delivery. Final sale items (marked “Final Sale” on the Product page) are not eligible for returns or refunds. Custom or personalized Products are also non-returnable unless they are defective or damaged (in which case we will offer a replacement or refund, per Section 4.3).
4.2 Return Process
To initiate a return:
- Email our customer service team at [email protected] with your order number, the name of the Product(s) you wish to return, and the reason for the return.
- We will respond within 24 business days with a return authorization number and instructions for shipping the Product(s) back to us.
- Package the Product(s) securely (preferably in the original packaging) and include the return authorization number on the outside of the package.
- Ship the return package to the address provided in our email. We recommend using a trackable shipping method, as we are not responsible for return packages that are lost in transit.
4.3 Refund Processing
Once we receive and inspect your returned Product(s) (typically within 3–5 business days of delivery to our warehouse), we will process your refund if the return meets our eligibility requirements. Refunds will be issued to the original payment method used to place the order, and will take 5–10 business days to appear in your account (timing may vary based on your bank or payment provider). We will notify you via email once the refund has been processed.
Refunds will include the full purchase price of the Product(s) (in USD) but will not include any fees imposed by your bank or payment provider (unless such fees result from our error). If you received a discount or promotional code on your order, the refund will be based on the discounted price paid.
5. Product Information and Warranties
5.1 Product Descriptions
We strive to provide accurate and detailed descriptions of our Products on the Site, including information about sizing, materials, and performance features. However, we do not warrant that Product descriptions, images, or other content on the Site are error-free, complete, or current. Slight variations in color, texture, or fit may occur due to manufacturing processes or differences in screen displays. 5.2 Limited Warranty
We warrant that our Products will be free from defects in materials and workmanship for 6 months from the date of delivery. If a Product is found to be defective within this period (e.g., faulty stitching, broken zippers, fabric flaws), please contact us with your order number and photos of the defect. We will, at our discretion, offer a replacement Product, a full refund, or a repair (where applicable). This warranty does not cover normal wear and tear, damage caused by improper use or care (e.g., washing in violation of care instructions), or damage from accidents or misuse.
6. Cancellations and Modifications
6.1 Order Cancellations
You may cancel your order at any time before it is processed (i.e., within 1–3 business days of order placement). To cancel an order, email us at [email protected] with your order number and a request to cancel. If your order has not yet been processed, we will issue a full refund within 5–10 business days. If your order has already been shipped, you will need to follow our return process (Section 4) to request a refund.
6.2 Order Modifications
We do not allow modifications to orders (e.g., changing Product sizes, adding or removing Products) after the order has been placed. If you need to make a change, please cancel your original order (if eligible) and place a new order with the desired modifications.
7. Limitation of Liability
To the maximum extent permitted by law, Outliear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your purchase or use of the Products, including but not limited to damages for lost profits, lost data, or inconvenience. Our total liability to you for any claim arising out of these Terms or your purchase shall not exceed the total amount you paid for the Products in question.
This limitation of liability does not apply to damages caused by our gross negligence or willful misconduct, or to damages arising from personal injury or property damage (to the extent required by law).
8. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page and post the revised Terms on the Site. Your continued use of the Site or placement of orders after the changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically for updates.
